Introductory provisions
The owner and operator of the websites, web portals or web applications (hereinafter referred to as the “Websites”) is GEN-I, trgovanje in prodaja elektricne energije, d.o.o., Vrbina 17, 8270 Krško (hereinafter referred to as “GEN-I”, the “Operator” ). The content administrator is GEN-I Hrvatska, d.o.o. trgovina i prodaja elektricne energije, Radnicka cesta 54, 10000 Zagreb (hereinafter referred to as “GEN-I Hrvatska”, the “Administrator”). They are jointly referred to as the “Controller”.
The users or visitors to the Websites are hereinafter generally referred to as the “User(s)”. The terms used in this Legal Notice are written in the masculine grammatical form, but they are used in a gender-neutral manner.
Terms of Use of the Websites
When accessing the GEN-I Websites, the User is obliged to read these Terms of Use carefully and to comply with them in full.
By visiting the GEN-I Websites, participating in online activities and similar activities of GEN-I, and generally by any use of the GEN-I Websites, the User agrees to these Terms of Use in their entirety. If the User does not agree with these Terms of Use, the Operator advises the User not to use these Websites.
The Terms of Use also apply in full and in the same manner to Users who access the GEN-I Websites as unregistered visitors. By accessing the Website, the User or visitor agrees to all the restrictions and conditions set out on the Website and confirms that he/she has been clearly and comprehensively informed about and accepts the Terms of Use, information about the Operator and the Data Processing and Cookie Policy. This document and any additional terms and conditions set out the terms of use of the GEN-I Websites and other online content and explain how the Operator uses personal data. For further information on the processing of personal data, the rights of data subjects and the obligations of the Operator, please refer to the Terms and Conditions of Personal Data Protection.
In an effort to protect its services and its Users, GEN-I reserves the right to block or otherwise prevent the delivery of any e-mail or other communication from or to the Websites or to prevent Users from violating the rights of others (e.g. copyrights). The Operator may use technology and other means to prevent or interrupt the use of the service.
GEN-I companies may also provide other applications and online services to Users which are not expressly covered by these Terms of Use. In such case, the (additional) terms of use will be made available to the User and will be communicated to the User at the start of the use of the respective application and online service.
Limitation of liability
The Operator makes every effort to provide accurate and up-to-date information on its Websites. The texts and information contained on the Websites are for information purposes only and have no legal effect and cannot give rise to any obligations or rights of any kind, nor can they be used in any proceedings for the exercise or proof of rights or claims of any kind, unless expressly provided for by applicable law. Nor does GEN-I guarantee their accuracy or completeness. All Users or visitors to the Websites use the published content at their own risk. The Operator reserves the right to change, add or remove the content of this Website at any time and without prior notice and accepts no liability for the consequences of such changes.
Neither the Operator nor any other legal or natural person involved in the creation and production of these Websites shall be held liable for their occasional malfunctioning, for any inaccuracy of the information, for the form and content of the information, or for any damage caused by the use of inaccurate or incomplete information. Therefore, they shall not be liable for any damage or inconvenience arising from the existence of the latter, from the access to and/or use of and/or inability to use the information contained therein and/or from any errors or omissions in their content, whether or not they have been advised of the possibility of such damage.
GEN-I Group Websites may also contain links to other websites that have no connection with GEN-I or its subsidiaries. The Operator cannot guarantee the accuracy of the content of any website to which it provides a link or reference and does not accept any responsibility for the content of these websites or the protection of data on these websites. The Operator is not responsible for the format and content of data obtained through links that are not its own, nor is it responsible for the respect of privacy on these links. When clicking such a link to another third party website, the User should be aware that these websites have their own terms of use and data privacy policies. The Operator advises the User and visitors to these websites to read the terms of use and protection of (personal) data of such websites.
Privacy protection
GEN-I, as the Controller of personal data, has prepared information for data subjects, called the Terms and Conditions of Personal Data Protection (which may also be referred to as the Personal Data Protection Statement), to ensure that data subjects are aware of the purposes and grounds for the processing of personal data and how to exercise their rights arising from the processing of personal data. The Terms and Conditions of Personal Data Protection also provide all other information required by the Slovenian personal data protection regulations and the General Data Protection Regulation (hereinafter referred to as the “GDPR”), namely Articles 13 and 14, as well as the notices referred to in Articles 15 to 22 and 34 of the GDPR, related to the processing of personal data, in a concise, transparent, comprehensible and easily accessible form and language. The Terms and Conditions of Personal Data Protection are permanently available at the Operator’s registered office, in all of the Operator’s business units and on the Operator’s Websites.
Processing of personal data means any operation or set of operations which is performed upon personal data or upon sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction. The personal data of data subjects will only be stored and used as long as it is necessary for the purpose or as long as there is an adequate basis for doing so, as further specified in the Terms and Conditions of Personal Data Protection.
In order to use certain (parts of) the GEN-I Websites or to participate in certain GEN-I activities, you must log in with a username and password. By logging in, the User agrees that the personal data provided by the User when obtaining a username and when using the GEN-I Websites may be used in the manner and for the purposes described in these Terms of Use and in the Terms and Conditions of Personal Data Protection.
In order to use certain (parts of) the website or to participate in certain activities or to use the GEN-I online applications, it is necessary to enter certain personal data (e.g. to fill in enquiry forms, to subscribe to newsletters, etc.). Such personal data will be processed in the manner and for the purposes described in the Terms and Conditions of Personal Data Protection. In order to use certain (parts of) the GEN-I Websites or to participate in certain GEN-I activities, it is necessary to log in with a username and password (e.g. Moj GEN-I Portal). By logging in, the User agrees that the personal data provided by the User when obtaining a username and when using the GEN-I Websites may be used in the manner and for the purposes described in these Terms of Use and in the Terms and Conditions of Personal Data Protection.
Some personal data may also be collected using so-called cookie technology. This type of data is also subject to the Terms and Conditions of Personal Data Protection and you can find more information about cookies in the Cookie Policy.
Personal data collected through the GEN-I Websites is processed in accordance with the relevant national data protection regulations and the GDPR. At the request of law enforcement authorities, personal data, including e-mail addresses, may be provided to the police and other competent authorities for further action in the event of misuse or breach.
GEN-I will not sell, transfer or disclose to anyone outside the GEN-I Group the data obtained by GEN-I on its Websites without the consent or permission of the User, unless otherwise required by law.
It is the User’s responsibility to ensure that the data provided is accurate and up to date. GEN-I, as the Controller of personal data, will, at the request of the User, complete or rectify personal data that is incomplete, inaccurate or out of date; erase personal data that the User requests and for which the Controller has no legal basis to retain; provide access to the User’s personal data; rectify the User’s personal data; and exercise any other rights of the data subject listed in the Terms and Conditions of Personal Data Protection. Each time a User visits the Website, the web server automatically stores information about web traffic (browser version, time of visit, etc.) in log files. The Controller does not process the data collected in this way separately and does not link it to other data. The web server log files are kept for a maximum of 3 months, after which they are deleted.
The Controller undertakes to protect the confidentiality of Users’ personal data. The Controller will use the collected data exclusively for the purposes for which the data were provided by the Users and within the limits of the legal provisions. The Controller will not use personal data and contact information for other purposes and will not disclose such data to third parties without the express consent of the User. The Controller will do its best to protect personal data from any violation and misuse.
The GEN-I Group may also provide Users with other applications and online services that are not expressly covered by these Terms of Use. In such case, the (additional) terms of use will be made available to the User and will be communicated to the User at the start of the use of the respective application and online service.
Additional Terms of Use for the moj.gen-i.hr Portal
The moj.gen-i.hr portal (hereinafter referred to as the “Moj GEN-I Portal”) provides the User with free access to information on contracts entered into with GEN-I and the use of information services, such as the submission of meter readings and similar services.
These Additional Terms of Use for the Moj GEN-I Portal apply and are binding in conjunction with the Terms of Use for the GEN-I Websites. In the event of any discrepancy between the provisions of the Terms of Use for the GEN-I Websites and these Additional Terms of Use for the Moj GEN-I Portal, the latter shall prevail.
These Additional Terms of Use for the Moj GEN-I Portal are binding and must be read and accepted by the User upon registration. Each time the Terms of Use are amended, the Users must acquaint themselves with and confirm the then applicable Terms of Use. When using the Moj GEN-I Portal, the User must keep up to date with the notices relating to the use of the Portal. Only a person of legal age may accept the Terms of Use and thus use the Moj GEN-I Portal.
The User may view and, to a certain extent, manage their contracts on the Moj GEN-I Portal if they are a registered User and if they are named as a contracting party on the contracts or if they have the consent/authorisation of the contracting party.
The User must enter the contract number and the number of at least one metering/off-take/transmission point on this contract in the “Link Contracts” section.
The User must properly protect the password, username and any other identification data on the Moj GEN-I Portal. In case of unauthorised use, the User is obliged to notify the Operator at mojgeni@gen-i.si. Upon notification of misuse, the Operator will disable the User’s account for security reasons, even if the user does not indicate or request this in the notification. The notification must include the User’s account details, e-mail address and details of the unauthorised use. Once the misuse has been identified and isolated, the Operator will re-enable the User’s account with a new password. In case of suspicion of misuse, unauthorised access to contractual data and related services, or in case of suspicion of providing false identification data, the Operator will deny the User access to the Portal or web application without prior notice. In case of suspicion that the User has committed a criminal offence, the Operator will lodge a criminal complaint against the User.
The Moj GEN-I Portal is used via the GEN-I software and web servers. All content on the Moj GEN-I Portal is the property of GEN-I and is subject to copyright or intellectual property protection.
All information on the Moj GEN-I Portal is for information purposes only and does not constitute proof of the contract being entered into or of its content or performance and, therefore, cannot be used in the process of exercising or proving rights under the contract. GEN-I shall not be liable for any information obtained, transmitted or disclosed by the User in error or without authorisation, nor for the consequences of such actions, which have caused or may cause damage to the User or to third parties.
The User may use the Moj GEN-I Portal only in accordance with these Additional Terms of Use. GEN-I may terminate access to the Moj GEN-I Portal or any of its functions at any time and without prior notice to the User.
Users use the Moj GEN-I Portal at their own risk. Neither GEN-I nor any other legal or natural person involved in the creation and development of the Portal shall be liable for any damage resulting from changes to the Portal, permanent or temporary interruption of the provision of use or any elements within the Portal, errors or omissions in the content, incorrect data input as well as the fact that the User has not protected the username, password or other data from the applications and has not kept them confidential.
When registering on the Moj GEN-I Portal, the Operator receives certain personal data from the User. The data set depends on whether the User registers directly in the GEN-I system or uses social networks to log in. All the above-mentioned personal data is collected and stored by the Operator in order to enable access to and use of the Moj GEN-I Portal. The data will be stored until the User’s account is deleted or as defined in the Terms and Conditions of Personal Data Protection. The User may unsubscribe from the Moj GEN-I Portal and/or request the deletion of the User’s account by sending a written request through one of the communication channels specified in the section “Contact GEN-I”. The Operator will delete the User’s account upon the User’s deregistration.
Copyright
GEN-I is the owner of all material copyrights to the copyrighted content in the broadest sense (content, text, graphic elements, photographs, illustrations or other representations of text, video, music, etc.) published on the Websites or in the web applications, in accordance with the applicable legislation on copyright and other related rights and intellectual property.
The content published by GEN-I may only be used for personal and non-commercial purposes. The content may not be reproduced, modified, copied, republished or redistributed without the express prior written permission of GEN-I, except where expressly permitted by law.
In the event of any authorised use of content published by GEN-I, all copyright and other proprietary notices and legends must be retained. Notwithstanding the permission granted above, the User must include the following notice on any reproduction or copy of the content of these Websites: “GEN-I, d.o.o. – all rights reserved”. Trademarks appearing on the Website are registered trademarks owned or licensed by GEN-I or third parties. Any use of these trademarks without the prior written consent of the right holder is expressly prohibited. All marks, including those not registered as trademarks, are protected by copyright. GEN-I will aggressively enforce its intellectual property rights to the fullest extent of the law.
It is permitted to link to the GEN-I Website if the content of the service is quoted. Links may not be posted on websites with illegal or immoral content. Upon GEN-I’s request, the owner and/or operator of the website on which the link is published is obligated to remove the link.
Unsolicited submission of ideas
GEN-I and its employees do not accept and consider as unsolicited any ideas, including ideas for new activities or services, advertising campaigns, new promotions, new products or technologies, processes, materials, marketing plans or names for new services or products. GEN-I requests that unsolicited ideas, presentations or other works not be sent to it. The purpose of these rules is to avoid any misunderstandings or disputes where GEN-I’s services or activities and products or marketing strategies may appear similar to ideas submitted to GEN-I. Therefore, GEN-I requests that Users do not send unsolicited ideas and materials to GEN-I or anyone associated with GEN-I in any way. If, despite this request, you choose to send GEN-I your ideas or materials, GEN-I makes no representation that the ideas or materials will be treated as confidential or as the property of the User.
Amendments to the Terms of Use
These Website Terms of Use may be updated from time to time by the Operator in accordance with changes or requirements in sectoral legislation, changes to services and activities, and based on feedback from Users. Each update will also be accompanied by the date of the update, which can be found at the end of the Terms of Use. In the event of material changes to the subject matter of these Terms of Use or changes to the way in which personal data is used, the Operator will notify Users in a prominent place or by direct communication to Users prior to implementing the changes. The Operator recommends that Users regularly review these Terms of Use to ensure that they are always informed about the Terms of Use and how the Operator protects their privacy.

Users may report misuse, make comments and ask questions about these Terms of Use, the Terms and Conditions of Personal Data Protection and/or their experience of using the GEN-I Website by sending a message to info@gen-i.hr.

These Terms of Use apply from the date of acceptance until revoked or amended. The Terms of Use were last updated on 18 October 2023.
